1. Introduction

Welcome to the TreeBot Discord bot (hereinafter referred to as the "bot"). By using or accessing the bot, you agree to comply with and be bound by the following Terms of Service ("ToS"). If you do not agree with these terms, please refrain from using the bot. These ToS govern your use of the bot and all associated services.

2. Acceptance of Terms

By accessing, interacting with, or using the bot, you indicate that you have read, understood, and agree to these ToS. You also agree to comply with any applicable rules, guidelines, and policies related to the use of the Discord platform. You must be at least 13 years old to use this bot or comply with your local minimum age requirement for using the Discord platform.

3. Changes to the Terms

We reserve the right to modify these ToS at any time. Continued use of the bot after any changes to the ToS constitutes your acceptance of the new terms.

4. Use of the Bot

The bot is intended for entertainment, utility, or other purposes as described by its features. By using the bot, you agree that you will not:

  1. Use the bot for any illegal, malicious, or unauthorized purpose.
  2. Exploit any vulnerabilities in the bot to access unauthorized features or services.
  3. Harass, abuse, or harm other users while using the bot.
  4. Use offensive, disruptive or abusive usernames.
  5. Use automated scripts, tasks or systems to access the bot.
  6. Use the bot to spam, flood, or engage in disruptive behaviors in any Discord server.

6. Service Availability and Updates

The bot is provided on an "as is" and "as available" basis. We make no guarantees regarding the uptime, reliability, or availability of the bot. We reserve the right to modify, update, or discontinue the bot (or any part of it) at any time without notice. We are not responsible for any loss, damage, or inconvenience caused by the bot unavailability.

We reserve the right to make any changes to the bot, including, but not limited to, creating balance changes, adjusting, removing or adding new features.

7. Termination of Use

We reserve the right to terminate or restrict your access to the bot at our sole discretion, without notice, for any reason, including but not limited to:

  1. Violation of these terms.
  2. Misuse of the bot.
  3. Engaging in behavior that is harmful to the bot, other users, or the Discord platform.

If your access is terminated, you agree to cease using the bot immediately without any refund.

8. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the bot is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the bot will be error-free or uninterrupted. Your use of the bot is at your sole risk.

In no event shall we be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the bot, including but not limited to damages for loss of data, loss of profits, or loss of goodwill.

9. Indemnification

You agree to indemnify, defend, and hold harmless to us, our developers, affiliates, and employees from and against any claims, liabilities, damages, losses, or expenses arising out of or in any way connected with your use of the bot, your violation of these ToS, or your violation of any law or the rights of a third party.

10. Governing Law

These ToS are governed by and constructed in accordance with the laws of Austria, without regard to its conflict of law principles. Any disputes arising out of or related to these ToS will be resolved in the courts of Austria.
